DECISION

The unanimous decision of the tribunal is that the claims were dismissed under Rule 27(5) of Schedule 1 to the Industrial Tribunals (Constitution and Rules of Procedure) Regulations (Northern Ireland) 2005.

The claimant did not appear and was not represented.

The respondent was represented by Ms McRoberts, Solicitor, of Crown Solicitor’s Office.

 

1.       The respondent’s representative had written to the claimant on 26 April 2012 asking if he wanted to continue with the case.  She had received no response.  She had contacted the Labour Relations Agency and the Labour Relations Agency had been unable to make contact with the claimant.  Edwards & Company, Solicitors, who had previously acted for the claimant had come off record on 2 April 2012 and stated:-

 

“Although we have tried to contact our client on numerous occasions by telephone, letter and e-mail he has failed to contact us with further instructions.”

 

2.       The tribunal was satisfied that the claimant had properly been served with a Notice of Hearing and that he had been aware of the hearing. 

 

3.       In the circumstances, there seemed to be no point in adjourning the matter or in taking up any more of the tribunal or the Crown Solicitor’s Office time in relation to these claims.  The claims were dismissed in accordance with Rule 27(5).
