THE INDUSTRIAL TRIBUNALS

CASE REF:   845/12

CLAIMANT:                           Desmond Graham

RESPONDENT:                    Robin Farquhar t/a W R Farquhar and Company

DECISION

The decision of the tribunal is that the claimant is awarded the sum of £3,283.20 in respect of a redundancy payment.

Constitution of Tribunal:

Chairman  (Sitting alone):       Mrs Ó Murray

Appearances:

The claimant appeared in person.

The respondent did not appear and was not represented.  No appearance was entered for the respondent.

REASONS

1.         The claimant was dismissed on 9 March 2012 without notice as the business was in difficulties.

2.         The claimant had been employed from March 2002 until the date of termination of his employment and the claimant was aged 59 at that date.  He had 9 full years’ employment with the respondent.

3.         The claimant’s gross pay was £243.20 and his net pay was £223.96.

4.         The calculation of redundancy therefore is as follows:

            13.5 weeks x £243.20 gross pay   =   £3,283.20

5.         Mr Graham indicated that his employer was Robin Farquhar who traded under the name W R Farquhar and Company.  I therefore amended the title of proceedings to reflect the position.

6.         This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.

Chairman:

Date and place of hearing:    26 July 2012, Belfast.

Date decision recorded in register and issued to parties:
