DECISION

 

 

(A)     The claimant’s wages claim against Early Years Day Care (Cookstown) Ltd (“the Company”) is well-founded and it is ordered that the Company shall pay to the claimant the sum of £1,458 in respect of wages.

 

(B)     The claimant’s holiday pay claim is well-founded and it is ordered that

              the Company shall pay to the claimant the sum of £190 in     

              respect of holiday pay.

 

(C)    The claimant’s claim for notice pay against the Company is well-founded and it is ordered that the Company shall pay to the claimant the sum of £716 in respect of notice pay.

 

(D)    The claimant’s redundancy pay claim against the company is well-founded and it is declared that the Company is liable to make a redundancy payment of £855 to the claimant.

 

(E)     The claims against Amanda Ferguson are withdrawn and accordingly they are dismissed.

 

(F)     The unfair dismissal claim against the Company will be the subject of a future hearing if the claimant decides to pursue that claim.

REASONS

 

  1. I announced my decision at the end of the hearing.  At the same time, I gave brief oral reasons for that decision.

 

  1. This Decision is based on the following information:

 

Gross weekly pay: £190

 

Net weekly pay: £185

 

Number of actual completed years of service: 4

 

Age on date of dismissal: 26

 

Multiplier (for redundancy pay): 4.5

 

 

  1. I am satisfied that the proper title of the second respondent is as stated above and the title of the proceedings was altered accordingly.

 

  1. The respondent applied for postponement. That application was refused, for reasons which will be confirmed in an IT10A record of the main hearing, which will be issued to the parties. 

 

  1. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
