THE INDUSTRIAL TRIBUNALS
CASE REF: 1931/13
CLAIMANT: Karen Elliott
RESPONDENT: Coolmar Ltd
DECISION ON A PRE-HEARING REVIEW
(1) The claimant’s application for leave to amend her claim form, so as to include an unfair dismissal claim, is refused.
(2) The claimant’s application for leave to amend her claim form, so as to include a claim under the Disability Discrimination Act is granted.
Constitution of Tribunal:
Employment Judge (Sitting alone): Employment Judge Buggy
Appearances:
The claimant was represented by Mr B O’Sullivan, Barrister-at-Law.
The respondent was represented by Mr P Moore, of MCL Associates Ltd.
REASONS
1. I announced my decision at the end of the hearing. At the same time, I gave oral reasons for that decision.
2. The claimant did not pursue an application for leave to amend her claim form so as to include a claim for breach of contract (she already has notice pay and holiday pay claims) claim.
3. It is clear that the claimant is already free to modify the amount claimed in respect of holiday pay, without leave of the tribunal.
