DECISION

The decision of the tribunal is that:

(1) the tribunal declares that the claimant's claim that the respondent has made an unauthorised deduction from the wages of the claimant in the sum of £3,741.99 is well founded;

 

(2) the tribunal finds that the respondent was in breach of its duty to the claimant to give to the claimant a written statement of particulars of employment;

 

(3) the tribunal orders the respondent to pay to the claimant the sum of £4,183.69, which sum is made up as follows namely:

 

(i) £3,741.99 (pursuant to Article 56(a) of the Employment Rights (NI) Order 1996);

 

(ii) £441.70 (2 weeks pay at £220.85 per week, pursuant to Article 27 of the Employment (NI) Order 2003);

 

(4) this is a relevant decision for the purposes of the Industrial tribunals (Interest) Order (Northern Ireland) 1990.
