AID TO INDUSTRY ACT (NORTHERN IRELAND) 1961 AID TO INDUSTRY ACT (NORTHERN IRELAND) 1961 - LONG TITLE An Act to enable certain further aid to be given to industries with a view to maintaining and increasing employment in Northern Ireland. [19th December 1961] Contributions towards purchases of coal, oil, gas and electricity for certain purposes. AID TO INDUSTRY ACT (NORTHERN IRELAND) 1961 - SECT 1 1.(1) For the purpose of maintaining and increasing employment, the Minister of Commerce (in this Act referred to as "the Minister") may, with the approval of the Minister of Finance, by order make provision for the payment by the Ministry of Commerce (in this Act referred to as "the Ministry") in accordance with the order, of contributions towards the cost incurred by registered persons [(a)in acquiring coal or oil; (b)in acquiring gas or electricity from a public gas or electricity undertaking; (c)in acquiring otherwise than from a public gas undertaking gas of such descriptions and in such quantities as may be specified in the order;] (2) An order made under this Act shall be subject to affirmative resolution. AID TO INDUSTRY ACT (NORTHERN IRELAND) 1961 - SECT 2 Provisions as to orders under this Act. 2.(1) An order made under this Act may contain such provisions as the Minister may consider necessary or desirable for the purposes of this Act including provisions for preventing fraud and provisions for securing economy in the use by registered persons of coal, [oil,] gas or electricity. (2) Without prejudice to the generality of sub-section (1), an order made under this Act may (a)provide for the maintenance of a register of persons for the purposes of this Act; (b)prescribe conditions which must be satisfied before a person may be registered and the circumstances in which the registration of any person may be cancelled; (c)require registered persons to furnish such information and to keep, produce and vouch such records and accounts as may be specified in the order; [(d)prescribe the method by which the amounts of contributions shall be calculated, so however that any method so prescribed for calculating the amounts of contributions (i)in respect of gas acquired from a public gas undertaking shall be related to the cost of coal, oil and gas used by public gas undertakings in Northern Ireland in producing gas for sale; (ii)in respect of electricity acquired from a public electricity undertaking shall be related to the cost of coal and oil used by public electricity undertakings in Northern Ireland in producing electricity for sale; <(iii)in respect of gas other than gas acquired from a public gas undertaking shall be such that the proportion which a contribution payable in respect of such gas would bear to the cost of such gas shall not be greater than the proportion which the total contributions payable in respect of gas acquired from public gas undertakings bear to the cost of gas so acquired;] (e)prescribe conditions upon which payment of contributions to registered persons may be made and the circumstances in which repayment of contributions in whole or in part may be required; (f)provide for refusing or withholding payment of contributions to registered persons who do not comply with such conditions or such procedure as may be specified in the order; (g)require public gas or electricity undertakings to furnish to the Ministry such information relating to [the quantities and cost of coal and oil used in the production of electricity for sale, the quantities and cost of coal, oil and gas used in the production of gas for sale] and the quantities of gas or electricity produced or sold, as the Ministry may require to enable it to calculate the amount of any contribution payable under this Act. AID TO INDUSTRY ACT (NORTHERN IRELAND) 1961 - SECT 3 Offences. 3.(1) Any person who, without the written consent of the Ministry, wilfully or knowingly (a)uses, or authorises or permits the use of, coal, [oil,] gas or electricity in respect of which a contribution has been paid pursuant to an order made under or continued in force by this Act for any purpose other than a purpose authorised or permitted by that order; or (b)disposes of, or authorises or permits the disposal of, coal, [oil,] gas or electricity in respect of which such a contribution has been paid; (2) Any person who (a)being required under this Act or any order made under, or continued in force by, this Act to furnish any information or record or account, furnishes any information or record or account which, to his knowledge, is false in a material particular; or Para.(b) rep. by 1969 c.16 (NI) s.31(2) sch.3 Pt.I S.4 spent. S.5(1) rep. by SLR 1973; subs.(2) spent AID TO INDUSTRY ACT (NORTHERN IRELAND) 1961 - SECT 6 Financial provisions. 6.Subs.(1) rep. by SLR 1976 (2) The contributions authorised by an order made under, or continued in force by, this Act shall be such that, taking one financial year with another, the aggregate amount of contributions payable in a financial year shall not exceed [one million, one hundred thousand pounds]. AID TO INDUSTRY ACT (NORTHERN IRELAND) 1961 - SECT 7 Interpretation. 7. In this Act "coal" means (a)bituminous coal, cannel coal, coke, anthracite; and (b)manufactured fuel (other than coke) which is carbonised to any extent in the process of manufacture and of which any of the substances mentioned in paragraph (a) hereof is the principal constituent; "Minister" and "Ministry" have the meanings assigned to them by sub-section (1) of section one; ["oil" means petroleum oil, coal tar and oil produced from coal, shale, peat or any other bituminous substance, and liquid hydrocarbon other than such hydrocarbon as is gaseous at a temperature of 16 degrees Centigrade (which is equivalent to 60.8 degrees Fahrenheit) and under a pressure of one atmosphere;] "public gas or electricity undertaking" means an undertaking whose principal business is the production of gas or electricity for public use; "registered person" means a person registered in accordance with an order made under, or continued in force by, this Act. AID TO INDUSTRY ACT (NORTHERN IRELAND) 1961 - SECT 8 Short title. 8. This Act may be cited as the Aid to Industry Act (Northern Ireland), 1961.
