41.(1) The Ministry may, in accordance, with the succeeding provisions of this Article, by order (a)transfer to the Service, as from the date, and subject to any exceptions and conditions, specified in the order (i)all the functions, assets and liabilities of the Authority and the Board; (ii)all the functions of other existing electricity undertakers and such of their assets and liabilities as may be specified in the order; (b)dissolve, as from the date, and save for any purpose, specified in the order, the Authority and the Board; (c)provide for any method of charge, tariff or agreement for the supply of electricity specified in the order to continue in force for the purposes of this Order until it is terminated or replaced by another tariff or agreement fixed or made under this Order; (d)modify the Contracts of Employment and Redundancy Payments Act (Northern Ireland) 1965 in its application to any person transferred to the employment of the Service by virtue of this Order; (e)provide for such incidental, consequential or supplemental matters as appear to the Ministry to be necessary or expedient for the purposes of giving full effect to the order or any part thereof including (without prejudice to the generality of this paragraph) provisions for any of the matters set out in Schedule 5. (2) An order under paragraph (1) shall be subject to affirmative resolution. (3) Stamp duty shall not be chargeable on an order under paragraph (1) or on any instrument executed for the purposes of giving effect thereto. (4) A certificate issued by the Ministry that any asset or liability has been transferred to the Service by virtue of an order under paragraph (1) shall be accepted as evidence of that fact and, upon lodgment of such a certificate relating to land, the certificate shall be registered in the Registry of Deeds or, in the case of registered land, the title to which the certificate relates shall be registered in the Land Registry.
