33.(1) Subject to paragraph (3), a person shall not, except with the consent of the Ministry (which consent may be subject to such terms and conditions as the Ministry thinks fit), construct or extend any generating station on any land. (2) An application for the consent of the Ministry under this Article (a)shall be in writing; (b)shall describe by reference to a map the land in relation to which the consent is required. (3) Paragraph (1) shall not apply to the construction or extension of any private generating station, so however that where a private generating station is to be constructed, the owner shall comply with the regulations (if any) made by the Ministry prescribing the type of current, frequency and pressure to be used. (4) Regulations made under paragraph (3) shall be so framed as not to interfere with the economic and efficient working of the business for which the supply of electricity is generated. (5) Where the Ministry has given its consent under this Article to the construction or extension of a generating station on any land, no person shall be entitled to restrain the use of the land for the purposes connected with the construction or operation of such a station. (6) The power of the Ministry to give its consent under this Article shall be construed as including power to review or revoke that consent or to vary the terms and conditions (if any) to which the consent was subject.
