HAIRDRESSERS ACT (NORTHERN IRELAND) 1939 - LONG TITLE

An Act to provide for the registration of premises in which the
trade or business of barber or hairdresser is carried on, and to
enable local authorities to make byelaws in respect of such
premises, and for other purposes connected therewith.{1}

or hairdresser.

HAIRDRESSERS ACT (NORTHERN IRELAND) 1939 - SECT 1

1. In the district of any [district council] in which this Act is
in force any premises in which the trade or business of barber or
hairdresser is carried on shall be registered by the occupier
thereof with the [district council] in such manner as the Ministry
of Home Affairs may by regulations prescribe, and any person using
or causing to be used for any such purpose as aforesaid any
premises not duly registered for that purpose shall be guilty of an
offence under this Act.

Power of district council to make byelaws.

2.(1) A [district council] may, from time to time, make byelaws,
for all or any of the following purposes:

(a)For the inspection of any premises in which the trade or
business of barber or hairdresser is carried on;

(b)For securing the cleanliness and the proper lighting and
ventilation of such premises;

(c)For prescribing precautions to be taken in such premises against
infection or contamination;

(d)For insuring that any person employed in such premises as barber
or hairdresser shall have received efficient instruction in the use
of any utensils or apparatus employed and in hygienic methods of
working;

(e)For insurance against liabilities to third parties arising out of
the trade or business of barber or hairdresser carried on in such
premises.

(3) Any officer authorised by the [district council] shall for the
purposes of this Act have power to enter and inspect at any
reasonable time, and on production of his authority, any premises
which such officer has reason to believe are used for the purpose
of carrying on the trade or business of barber or hairdresser.

(4) Any person who obstructs or impedes any such officer in the
exercise of his powers under this section shall be guilty of an
offence under this Act.

Penalties.

3.(1) Any person guilty of an offence under this Act shall be
liable on conviction to a fine not exceeding five pounds, and to a
fine not exceeding two pounds for each day on which any such
offence is continued by the said person after conviction.

(2) The court by which any person is convicted of an offence under
this Act or against any byelaw made thereunder may, in addition to
imposing a penalty, by order cancel the registration of the premises
in relation to which the offence was committed; and as from the
date of the order the premises therein referred to shall be deemed
to be premises which are not duly registered under this Act and
the [district council] may amend their register accordingly.

Prosecution of offences.

4.(1) All offences under this Act shall be prosecuted, and all
fines thereunder shall be recovered, in manner provided by the
Summary Jurisdiction Acts (Northern Ireland); and a person aggrieved
by a conviction or order made by a court of summary jurisdiction
on determining any information or complaint under this Act may
appeal in manner provided by the said Summary Jurisdiction Acts.

(2) Prosecutions for offences under this Act or against any byelaw
made thereunder may be instituted by an officer of the [district
council] authorised in that behalf by the [council] or by any
member of the Royal Ulster Constabulary acting within the district
of the [council].

Extent and application of Act.

5.(1) The foregoing provisions of this Act shall extend to the
district of any [district council] in which, by an order of the
Ministry of Home Affairs, this Act is declared to be in force.

(2) The Ministry of Home Affairs may, on the application of [any
district council], by order declare this Act to be in force in the
district of such council, and any such order shall be published in
such manner as the said Ministry may direct.
