INDUSTRIAL ADVICE AND ENTERPRISE ACT (NORTHERN IRELAND) 1964 INDUSTRIAL ADVICE AND ENTERPRISE ACT (NORTHERN IRELAND) 1964 - LONG TITLE An Act to provide for the payment of grants towards expenditure incurred by manufacturing undertakings in obtaining advice intended to increase the efficiency of those undertakings; to establish, and provide for the giving of financial assistance from, a fund to assist and encourage industrial enterprise, the development of industry and training for industrial management; and for purposes connected with those matters. [18th March 1964] PART I INDUSTRIAL ADVICE AND ENTERPRISE ACT (NORTHERN IRELAND) 1964 - SECT 1 1.... the Ministry of Commerce (in this Act referred to as "the Ministry") .... Ss.27 rep. by 1967 c.10 (NI) s.1(4); 1970 c.23 (NI) s.1 sch.; SLR 1980 1950 c.3 INDUSTRIAL ADVICE AND ENTERPRISE ACT (NORTHERN IRELAND) 1964 - SECT 8 8.(1) There shall be established a fund to be called the Industrial Enterprise Fund, which shall be under the control and management of the Ministry and shall be used, in accordance with the provisions of this Part, for the purpose of making grants and loans with the object of assisting and encouraging industrial enterprise, the development of industry, and training for industrial management. (2) There shall be issued to the Industrial Enterprise Fund out of the Reserve Fund (established pursuant to section 21 of the Exchequer and Financial Provisions Act (Northern Ireland) 1950), as the Ministry of Finance may direct, a sum not exceeding three hundred and twenty thousand pounds. (3) Any sums from time to time standing to the credit of the Industrial Enterprise Fund which are not immediately required for the purposes thereof shall be invested in such manner as the Ministry, with the approval of the Ministry of Finance, may direct, and any interest or profit arising on such investment shall be added to the Fund and may be used for the purposes thereof. INDUSTRIAL ADVICE AND ENTERPRISE ACT (NORTHERN IRELAND) 1964 - SECT 9 Accounts of the Industrial Enterprise Fund. 9.(1) Where the Ministry considers that to (a)assist or encourage industrial enterprise; or (b)assist in the development of industry; or (c)provide or assist in the provision of training for industrial management; (2) Before making any loan or grant from the Industrial Enterprise Fund the Ministry (a)shall have regard to any other sources of financial assistance available to the applicant; (b)may refer any application to the advisory committee established pursuant to section 12 for its advice. INDUSTRIAL ADVICE AND ENTERPRISE ACT (NORTHERN IRELAND) 1964 - SECT 10 Winding up of the Industrial Enterprise Fund. 10.(1) The Ministry shall, as respects each financial year, prepare an account of receipts into and payments out of the Industrial Enterprise Fund. (2) Any account prepared under this section shall, on or before the 30th November next following the expiration of the relevant financial year, be transmitted to the Comptroller and Auditor-General who shall examine and certify the account. (3) The Ministry shall lay a copy of any account prepared under this section, together with the report of the Comptroller and Auditor-General thereon, before each House of Parliament. INDUSTRIAL ADVICE AND ENTERPRISE ACT (NORTHERN IRELAND) 1964 - SECT 11 Advisory committee. 11. The Ministry, having regard to the sums standing to the credit of the Industrial Enterprise Fund, may, with the approval of the Ministry of Finance, by order provide for the winding up of the Fund, and there shall be made such payments as may be specified for that purpose by any such order. Publicity. INDUSTRIAL ADVICE AND ENTERPRISE ACT (NORTHERN IRELAND) 1964 - SECT 12 12.(1) The Minister of Commerce may establish an advisory committee to advise the Ministry on such questions relating to the administration of this Act and matters connected therewith as the Ministry may refer to the committee. (2) The Minister of Commerce shall appoint as members of the advisory committee such persons as appear to the Minister to be qualified to advise on the matters to be referred to the committee. (3) Expenses incurred by the advisory committee with the approval of the Ministry and the sanction of the Ministry of Finance shall be defrayed out of moneys provided by Parliament. INDUSTRIAL ADVICE AND ENTERPRISE ACT (NORTHERN IRELAND) 1964 - SECT 13 Recovery of amounts repayable. 13.(1) The Ministry may from time to time expend money, up to such amounts as the Ministry of Finance may sanction, for the purposes of publicising the provisions of this Act with respect to Para.(a) rep. by SLR 1980 (b)applications for, and the giving of, financial assistance from the Industrial Enterprise Fund. (2) Money so expended shall be defrayed out of moneys provided by Parliament. INDUSTRIAL ADVICE AND ENTERPRISE ACT (NORTHERN IRELAND) 1964 - SECT 14 Disclosure of information. 14. Any amount which is repayable to the Ministry under this Act (a)shall be recoverable as a debt due to the Ministry and may, without prejudice to the right of the Ministry to sue in the High Court for the recovery thereof or to any other remedy for the recovery thereof, be recoverable by the Ministry in the county court by civil bill or summarily as a civil debt; or (b)if not so recovered, may be recovered by deduction from any grant or other sum payable out of moneys provided by Parliament or by any Ministry of Northern Ireland or other public authority of the Government of Northern Ireland to the undertaking from which, or the person from whom the amount is due, and that grant or other sum shall be abated accordingly. INDUSTRIAL ADVICE AND ENTERPRISE ACT (NORTHERN IRELAND) 1964 - SECT 15 False information. 15.(1) Any information which is obtained under this Act (a)relating to a [qualifying] undertaking; or (b)from an applicant for financial assistance from the Industrial Enterprise Fund; (2) Any person who contravenes subsection (1) shall be guilty of an offence. INDUSTRIAL ADVICE AND ENTERPRISE ACT (NORTHERN IRELAND) 1964 - SECT 16 Penalties. 16. Any person who (a)being required under this Act to furnish any information or make any report to the Ministry, furnishes any information or makes any report which, to his knowledge, is false in a material particular; or (b)in relation to Sub-para.(i) rep. by SLR 1980 (ii)an application for, or the giving of, financial assistance from the Industrial Enterprise Fund; (b)makes any statement which, to his knowledge, is false in a material particular or fraudulently uses any document; 1979 NI 19 INDUSTRIAL ADVICE AND ENTERPRISE ACT (NORTHERN IRELAND) 1964 - SECT 17 17. Any person who is guilty of an offence under section 15 or (without prejudice to [Article 10 of the Perjury (Northern Ireland) Order 1979]) section 16 shall be liable on summary conviction to a fine not exceeding two hundred pounds or to imprisonment for a term not exceeding one year or to both such fine and such imprisonment. INDUSTRIAL ADVICE AND ENTERPRISE ACT (NORTHERN IRELAND) 1964 - SECT 18 Annual report of proceedings of Ministry. 18.(1) Notwithstanding any provision in any Act prescribing the period within which summary proceedings may be commenced, proceedings for an offence under this Act may be commenced at any time within the period of three months from the date on which evidence, sufficient in the opinion of the Ministry to justify a prosecution for the offence, comes to the knowledge of the Ministry, or within the period of twelve months after the commission of the offence, whichever period last expires. (2) For the purposes of subsection (1) a certificate, purporting to be signed by the Minister of Commerce or a secretary or assistant secretary of the Ministry, as to the date on which such evidence has as aforesaid come to the knowledge of the Ministry shall be conclusive evidence thereof. S.19 rep. by SLR 1980 INDUSTRIAL ADVICE AND ENTERPRISE ACT (NORTHERN IRELAND) 1964 - SECT 20 Interpretation. 20. The Ministry shall annually make to Parliament a report of its proceedings under this Act during a preceding year, and a copy of such report shall be laid before each House of Parliament. INDUSTRIAL ADVICE AND ENTERPRISE ACT (NORTHERN IRELAND) 1964 - SECT 21 1948 c.4 21. In this Act ["construction undertaking" means any person engaged in Northern Ireland in any activity for or incidental to the construction, alteration or demolition of a building or of any other fixed works of construction or civil engineering, including a road;] Definition rep. by SLR 1980 ["hotel undertaking" means any person engaged in Northern Ireland in operating any premises registered in the register of hotels maintained under section 10 of the Development of Tourist Traffic Act (Northern Ireland) 1948;] Definition rep. by SLR 1980 "manufacturing undertaking" means any person engaged in Northern Ireland in (a)the making for sale, in the course of a trade or business, of any article or substance (or the making or repairing of a ship, vessel or aircraft) or part of any such article or substance; or (b)the carrying out, in the course of a trade or business, of a process or processes connected with the manufacture of any such article, substance or part, including the ornamenting, washing, preserving or adapting of any such article, substance or part for the purpose of making it saleable; "the Ministry" has the meaning assigned by section 1; ["qualifying undertaking" means a construction, hotel or manufacturing undertaking.] INDUSTRIAL ADVICE AND ENTERPRISE ACT (NORTHERN IRELAND) 1964 - SECT 22 22. This Act may be cited as the Industrial Advice and Enterprise Act (Northern Ireland) 1964.
