Dismissal without prejudice to further complaint as to same matter. 96.(1) Without prejudice to the provisions of any enactment specified in section 110(9) [and subject to Article 25(2) of the Domestic Proceedings (Northern Ireland) Order 1980], where a court of summary jurisdiction has made an order for the periodical payment of money the court or any court of summary jurisdiction acting for the same petty sessions district may at any time on the application of any person by whom or to whom or in respect of whom payments are to be made or on whose complaint the order was made revoke, suspend, revive, vary or discharge the order. (2) The court may exercise its powers of revocation, revival, suspension, variation or discharge, whether under this section or the enactments referred to in subsection (1), at any time and shall do so by order. (3)The power to vary an order shall include power (a)to direct that sums payable under the order shall henceforth be paid to some person other than the person named in the order varied; (b)to add to the order varied any provision authorised by the enactment under which the order was made.
