Contracts not avoided by convictions. 37.(1) Subject to the provisions of this Act, where a pawnbroker is convicted of an offence against this Act (not being an offence against the provisions of this Act relating to licences) any contract made by him with a pawner or otherwise in relation to his business shall not be void by reason only of such conviction, nor by reason only thereof shall he lose his lien on or right to the pledge or to the loan and profit. (2) Nothing in this section shall restrict the operation of any provision of this Act providing for the delivery, by order of a court or resident magistrate or justice of the peace, to the lawful owner of any goods or chattels unlawfully pawned.
