REGISTRATION OF BIRTHS, DEATHS AND MARRIAGES (FEES, ETC.) ACT
(NORTHERN IRELAND) 1955 - LONG TITLE

An Act to amend the law relating to the fees payable for or in
respect of the solemnization of marriages and certain matters
regulated by the enactments relating to the registration of births,
deaths, marriages and adoptions; to extend the time for making
certain entries and alterations in registers of births; and for
purposes connected with the matters aforesaid.

Fees for or in respect of the solemnization of marriages, the
registration of marriages and certain other events, and for relevant
searches and certificates.

1.(1) There shall be payable for or in respect of

(a)the solemnization of marriages;

(b)the registration of events required or authorised to be registered
in any register or other book required or authorised by or under
any enactment to be kept for the purpose of providing or
maintaining records of ..., marriages ...;

(c)searches in any such registers or books; and

(d)certificates relating to any such events;

(2) The Governor may by Order in Council prescribe the fees payable
for the purposes of sub-section (1).

(3) An Order in Council shall not be made under this section or
section two unless and until a draft thereof has been approved by
a resolution of each House of Parliament.

Subs.(4), with First Schedule, effects amendments

(5) Where any fee is prescribed under this section, then, subject
to the provisions of any enactment to the contrary, it shall not
be lawful for any person to demand or receive, in respect of any
transaction to which that fee relates, any sum in excess of the
prescribed fee, other than a sum equal to the amount of any
expenditure properly incurred in the carrying out of that
transaction.

Proof of marriage for purposes of enactments.

2.(1) Where the ..., marriage ... of a person is required to be
proved for the purposes of any enactment specified in the Second
Schedule, any person shall, on presenting a written requisition in
such form and containing such particulars as may be directed by the
Ministry of Finance and on payment of such fee or fees as shall
be prescribed, be entitled to obtain a certified copy of the entry
of the ..., marriage ... of that person in the relevant register
under the hand of the person having the custody thereof, and forms
for such requisition shall on request be supplied without any charge
by every person having the custody of the register.

(2) Regulations made under ... the Marriages (Ireland) Act, 1844,
may provide for the furnishing by ... registrars of marriages,
subject to the payment of such fees as may be prescribed under
this Act, of such information (including copies of or extracts from
the registers or other books in their custody) as may be provided
by the regulations for the purposes of any enactment specified in
the Second Schedule.

(3) The Governor may by Order in Council add to the enactments
specified in the Second Schedule any other enactment for the
purposes of which the provisions of this section are to be applied;
and where such an Order in Council is made this section and that
Schedule shall have effect accordingly.

Meaning of ""enactment''.

4. In this Act the expression "enactment" includes any instrument
made under a statute.

Short title.

6.(1) This Act may be cited as the Registration of Births, Deaths
and Marriages (Fees, etc.) Act (Northern Ireland), 1955.
