Carriage of Dangerous Goods (Amendment) Regulations (Northern Ireland) 2002

  Made 8th February 2002 
  Coming into operation 1st April 2002 

The Department of Enterprise, Trade and Investment[1], being the Department concerned[2], in exercise of the powers conferred on it by Articles 17(1), (2), (4), (5), (6), 40(2) to (4) and 55(2) of, and paragraphs 1(1), (2), (4), 2, 5(2), 6, 11, 13 and 15 of Schedule 3 to, the Health and Safety at Work (Northern Ireland) Order 1978[3] and of every other power enabling it in that behalf and for the purpose of giving effect without modifications to proposals submitted to it by the Health and Safety Executive for Northern Ireland[4] under Article 13(1A) of that Order after the carrying out by the said Executive of consultations in accordance with Article 46(3) of that Order, hereby makes the following Regulations:

Citation and commencement
     1. These Regulations may be cited as the Carriage of Dangerous Goods (Amendment) Regulations (Northern Ireland) 2002 and shall come into operation on 1st April 2002.

Amendment to the Pressure Systems and Transportable Gas Containers Regulations (Northern Ireland) 1991
    
2. The Pressure Systems and Transportable Gas Containers Regulations (Northern Ireland) 1991[5] shall be amended in accordance with Schedule 1.

Amendments to the Carriage of Dangerous Goods (Classification, Packaging and Labelling) and Use of Transportable Pressure Receptacles Regulations (Northern Ireland) 1997
     3. The Carriage of Dangerous Goods (Classification, Packaging and Labelling) and Use of Transportable Pressure Receptacles Regulations (Northern Ireland) 1997[6] shall be amended in accordance with Schedule 2.

Amendments to the Carriage of Dangerous Goods by Road Regulations (Northern Ireland) 1997
     4. The Carriage of Dangerous Goods by Road Regulations (Northern Ireland) 1997[7] shall be amended in accordance with Schedule 3.

Amendments to the Carriage of Dangerous Goods by Road (Driver Training) Regulations (Northern Ireland) 1997
     5. The Carriage of Dangerous Goods by Road (Driver Training) Regulations (Northern Ireland) 1997[8] shall be amended in accordance with Schedule 4.

Amendments to the Health and Safety (Fees) Regulations (Northern Ireland) 1998
     6. The Health and Safety (Fees) Regulations (Northern Ireland) 1998[9] shall be amended in accordance with Schedule 5.

Amendments to the Carriage of Dangerous Goods by Rail Regulations (Northern Ireland) 1998
     7. The Carriage of Dangerous Goods by Rail Regulations (Northern Ireland) 1998[10] shall be amended in accordance with Schedule 6.

Amendments to the Packaging, Labelling and Carriage of Radioactive Material by Rail Regulations (Northern Ireland) 1998
     8. The Packaging, Labelling and Carriage of Radioactive Material by Rail Regulations (Northern Ireland) 1998[11] shall be amended in accordance with Schedule 7.

EXPLANATORY NOTE

(This note is not part of the Regulations.)


     1. These Regulations implement - 

insofar as they relate to the carriage of dangerous goods other than explosives.

     2. The Regulations amend - 

     3. The effect of the amendments is to align the Regulations mentioned in paragraph 2 with the latest versions of the ADR and RID agreements, as defined in regulation 2(1) of the Carriage of Dangerous Goods (Classification, Packaging and Labelling) and Use of Transportable Pressure Receptacles Regulations (Northern Ireland) 1997.

     4. Apart from minor and drafting amendments, the principal modifications are - 

     5. Copies of relevant documents may be obtained as follows - 

     6. In Great Britain, the corresponding Regulations are the Carriage of Dangerous Goods (Amendment) Regulations 1999 (S.I. 1999/303). Copies of the cost benefit assessment relating to those Regulations together with a Northern Ireland Supplement prepared by the Department of Enterprise, Trade and Investment are held at the offices of the Health and Safety Executive for Northern Ireland at 83 Ladas Drive, Belfast BT6 9FR from where copies may be obtained on request.

     7. A person who contravenes these Regulations or any requirement or prohibition imposed thereunder, is guilty of an offence under Article 31 of the Health and Safety at Work (Northern Ireland) Order 1978 and is liable, on summary conviction, to a fine not exceeding the statutory maximum (currently £5,000) or, on conviction on indictment, to a fine.
