HEALTH AND SAFETY

The Control of Substances Hazardous to Health (Amendment) Regulations (Northern Ireland) 2005

  Made 24th March 2005 
  Coming into operation -
  All regulations except regulations 3(a), (c) to (f) and (h) and 4(b) 1st May 2005 
  Regulations 3(a), (c) to (f) and (h) and 4(b) 1st June 2005 

The Department of Enterprise, Trade and Investment[1], being the Department concerned[2], in exercise of the powers conferred by Articles 2(5), 17(1), (2), (4), (5) and (6), and 55(2) of, and paragraphs 1(1) and (4), 7, 8, 10, 13, 14, 15 and 19 of Schedule 3 to, the Health and Safety at Work (Northern Ireland) Order 1978[3] and of every other power enabling it in that behalf and for the purpose under Article 46(1)[4] of that Order of giving effect without modifications to proposals submitted to it by the Health and Safety Executive for Northern Ireland[5] under Article 13(1A)[6] of that Order after the carrying out by the said Executive of consultations in accordance with Article 46(3) of that Order, hereby makes the following Regulations:

Citation and commencement
     1. These Regulations may be cited as the Control of Substances Hazardous to Health (Amendment) Regulations (Northern Ireland) 2005 and shall come into operation on 1st May 2005, except for regulations 3(a), (c) to (f) and (h), and 4(b) which shall come into operation on 1st June 2005.

Amendment of the Chemicals (Hazard Information and Packaging for Supply) Regulations (Northern Ireland) 2002
    
2. In the Chemicals (Hazard Information and Packaging for Supply) Regulations (Northern Ireland) 2002[7] for paragraph 11 of Part II B of Schedule 5 there shall be substituted the following paragraph -

Regulation 3(h)



EXPLANATORY NOTE

(This note is not part of the Regulations.)


     1. These Regulations amend the Control of Substances Hazardous to Health Regulations (Northern Ireland) 2003 (S.R. 2003 No. 34) ("the COSHH Regulations"), the Chemicals (Hazard Information and Packaging for Supply) Regulations (Northern Ireland) 2002 (S.R. 2002 No. 301) ("the CHIP Regulations"), and the Control of Lead at Work Regulations (Northern Ireland) 2003 (S.R. 2003 No. 35) ("the CLAW Regulations").

     2. The Regulations implement as respects Northern Ireland the provisions concerning chromium VI in cement contained in Directive 2003/53/EC of the European Parliament and of the Council (O.J. No. L178, 17.7.2003, p. 24) amending for the 26th time Council Directive 76/769/EEC by amending the COSHH Regulations to prohibit the supply and use of cement and cement-containing preparations containing when hydrated more than 0·0002% soluble chromium VI of the dry weight of the cement except in certain fully automated and enclosed processes (regulation 3(g)), and by amending the CHIP Regulations by adding a requirement to mark the packaging of cement whose chromium VI content would exceed that limit but for the use of reducing agents with information on how long and in which conditions those agents will remain effective (regulation 2).

     3. The Regulations further amend the COSHH Regulations by -

The Regulations amend the CLAW Regulations by excluding defined shipboard activities of ships' crews, except for Navy ships, from their operation (regulation 4(a)), and by introducing a duty to review control measures other than the provision of plant and equipment, including systems of work and supervision, at suitable intervals (regulation 4(b)).

     5. Copies of the publications mentioned in the Regulations as follows -

     6. In Great Britain, the corresponding Regulations are the Control of Substances Hazardous to Health (Amendment) Regulations 2004 (S.I. 2004 No. 3386). Copies of the Regulatory Impact Assessments relating to those Regulations, together with a Northern Ireland Supplement, are held at the offices of the Health and Safety Executive for Northern Ireland at 83 Ladas Drive, Belfast BT6 9FR from where copies may be obtained on request.

     7. A person who contravenes the Regulations is guilty of an offence under Article 31 of the Health and Safety at Work (Northern Ireland) Order 1978 and is liable, on summary conviction, to a fine not exceeding the statutory maximum (currently £5,000) or, on conviction on indictment, to a fine.
