FISHERIES

The Foyle Area and Carlingford Area (Close Seasons for Angling) (Amendment) Regulations 2005

  Made 18th August 2005 
  Coming into operation 18th August 2005 

The Foyle, Carlingford and Irish Lights Commission, in exercise of the powers conferred on it by section 13(1) (amended by section 34(3) of the British-Irish Agreement Act 1999[1]) and section 5(1) of the British-Irish Agreement (Amendment) Act 2002[2]) and section 28(2) and (4) of the Foyle Fisheries Act 1952[3] which stand transferred to it under section 34(1) of the British-Irish Agreement Act 1999, and in exercise of the powers conferred on it by section 13(1) and section 27(2) and (4) of the Foyle Fisheries Act (Northern Ireland) 1952[4] and now vested in it[5] and of all other powers enabling it in that behalf, with the approval of the Government of Ireland and the Government of the United Kingdom of Great Britain and Northern Ireland, under the agreement made between those Governments on 19th November 2002[6] and section 5(1) of the British-Irish Agreement (Amendment) Act 2002, hereby makes the following Regulations:

Citation and commencement
     1. These Regulations may be cited as the Foyle Area and Carlingford Area (Close Seasons for Angling) (Amendment) Regulations 2005 and shall come into operation on 18th August 2005.

Amendment of the Foyle Area and Carlingford Area (Close Seasons for Angling) Regulations 2001
    
2. For the Schedule to the Foyle Area and Carlingford Area (Close Seasons for Angling) Regulations 2001[7] there shall be substituted the Schedule set out in the Schedule to these Regulations.

Revocation
     3. The Foyle Area and Carlingford Area (Close Seasons for Angling) (Amendment) Regulations 2004[8] are hereby revoked.

Regulation 2


REPLACEMENT SCHEDULE OF THE FOYLE AREA AND CARLINGFORD AREA (CLOSE SEASONS FOR ANGLING) REGULATIONS 2001





EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations amend the Foyle Area and Carlingford Area (Close Seasons for Angling) Regulations 2001 by bringing the beginning of the close season for salmon and trout in the River Strule and its tributaries upstream of its confluence with the River Owenkillew in line with the other rivers in the Foyle Area (except the Rivers Foyle and Finn), prescribing a close season running from the 21st October to 31st March next following, both dates inclusive. These Regulations also prescribe a close season for Binevenagh Dam.
