The Department for Social Development [1] makes the following regulations in exercise of the powers conferred by Article 17(1), (2), (3) and (4) of the Social Security (Northern Ireland) Order 1990 [2], and now vested in it [3], and with the consent of the Department of Finance and Personnel:
Citation and commencement
1.
These Regulations may be cited as the Domestic Energy Efficiency Grants (Amendment No. 5) Regulations (Northern Ireland) 2006 and shall come into operation on 8th May 2006.
Amendments
2.
The Domestic Energy Efficiency Grants Regulations (Northern Ireland) 2002 [4] are amended in accordance with regulations 3 and 4.
3.
In paragraph (2) of regulation 4, for the words "paragraph (3) applies" substitute "paragraphs (3) and (4) apply".
4.
In regulation 6, after paragraph (2) insert—
"
(3) In the case of asbestos being discovered within the property, to facilitate the removal of the asbestos, the scheme manager shall not pay a total amount of grant in respect of an application qualifying under regulation 4(2) exceeding the amount properly charged for the works or £6,000, whichever is the lesser."

EXPLANATORY NOTE
(This note is not part of the Regulations)
The Domestic Energy Efficiency Grants Regulations (Northern Ireland) 2002 ("the 2002 Regulations") enable the Department for Social Development to make or arrange for the making of grant for the improvement of energy efficiency in dwellings occupied by persons on low incomes with children, elderly persons on low incomes and persons in receipt of benefit relating to ill health or disability.
These Regulations amend the 2002 Regulations to extend the eligibility of Warm Homes Plus and to increase the grant limit to £6,000 in properties containing asbestos for the removal of asbestos.
