Foyle Area and Carlingford Area (Tagging and Logbook) (Amendment) Regulations 2007

The Foyle, Carlingford and Irish Lights Commission, in exercise of its powers under section 13(1) (amended by section 34(3) of the British-Irish Agreement Act 1999[1] and section 5(1) of the British-Irish Agreement (Amendment) Act 2002[2]) and section 14 of the Foyle Fisheries Act 1952[3] which stand transferred to it under section 34(1) of the British-Irish Agreement Act 1999, and in exercise of the powers conferred by sections 13(1) and 14 of the Foyle Fisheries Act (Northern Ireland) 1952[4] and now vested in it[5], with the approval of the Government of Ireland and the Government of the United Kingdom of Great Britain and Northern Ireland, under the agreement made between those Governments on 19th November 2002[6] and section 5(1) of the British-Irish Agreement (Amendment) Act 2002, hereby makes the following Regulations:
Citation and Commencement
1.
These Regulations may be cited as the Foyle Area and Carlingford Area (Tagging and Logbook) (Amendment) Regulations 2007 and shall come into operation on 9th May 2007.
Amendment of the Foyle Area and Carlingford Area (Tagging and Logbook) Regulations 2001
2.
The Foyle Area and Carlingford Area (Tagging and Logbook) Regulations 2001[7] shall be amended in accordance with regulations 3 to 8.
Interpretation
3.
For regulation 2 —
(1) In the definition of "authorised senior helper" for the words "regulation 4 of the Foyle Area (Licensing of Fishing Engines) Regulations 1976" there shall be substituted the words "regulation 4 of the Foyle Area and Carlingford Area (Licensing of Fishing Engines) Regulations 2001[8]";
(2) For the definition of "game fishing rod licence" there shall be substituted –
"
"game fishing rod and line licence" means a game fishing rod and line licence issued in pursuance of the Foyle Area and Carlingford Area (Licensing of Fishing Engines) Regulations 2001;"
(3) In the definition of "logbook" for the word "one" there shall be substituted the word "three";
(4) The definition of "one day angling logbook" shall be omitted;
(5) After the definition of "tail tag" there shall be inserted –
"
"three day angling logbook" means a logbook as set out in the format prescribed in Schedule 1;"
(6) In the definition of "wild sea trout" for the figure 50 there shall be substituted the figure 40.
Tagging of wild salmon and sea trout
4.
For regulation 3(4) there shall be substituted—
"
(4) In this regulation "an appropriate gill tag" means —
(a) in a case where the wild salmon or sea trout was captured by rod and line, during the period 1st March to 31st May both dates inclusive, a blue gill tag;
(b) in a case where the wild salmon or sea trout was captured by rod and line, during the period 1st June to 31st October both dates inclusive, a black gill tag.
And which, in each case, meets the requirements set out in paragraph (5)."
Issue of gill tags to holders of fishing licences
5.
For regulation 4 there shall be substituted—
"
Issue of gill tags to holders of fishing licences
4.
—(1) Any person holding a three day game fishing rod and line licence may be issued by the distributor with —
(a) during the period 1st January to 31st May, up to but not exceeding 3 tags;
(b) during the period 1st June to 31st October, up to but not exceeding 6 tags;
(2) Any person holding a game fishing rod and line licence other than a three day game fishing rod and line licence may be issued by the distributor with –
(a) during the period 1st January to 31st May, up to but not exceeding 5 tags;
(b) during the period 1st June to 31st October, up to but not exceeding 20 tags;
(3) Any person holding a fishing licence, other than a game fishing rod and line licence, shall be issued by the Commission with a sufficient number of gill tags to enable him to comply with these regulations.
(4) In this regulation "the distributor" means the Commission or authorised agent who issued the fishing licence."
Issue and return of logbooks
6.
In regulation 6(1) after the word "rod," wherever it occurs, there shall be inserted "and line".
7.
For regulation 7 there shall be substituted–
"

The Commission or an authorised agent shall issue –
(a) a salmon and sea trout angling logbook to the holder of a game fishing rod and line licence other than a three day game fishing rod and line licence;
(b) a three day angling logbook to the holder of a three day game fishing rod and line licence."
8.
For Schedule 1 to the Foyle Area and Carlingford Area (Tagging and Logbook) Regulations 2001 there shall be substituted the Schedule as set out in the Schedule to these Regulations.

Replacement Schedule to the Foyle Area and Carlingford Area (Tagging and Logbook) Regulations 2001
EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations amend the Foyle Area and Carlingford Area (Tagging and Logbook) Regulations 2001 by –
(a) omitting the definition of "one day angling logbook" and inserting a definition of "three day angling logbook" (regulation 3);
(b) altering the colour requirements for gill tags (regulation 4);
(c) providing that up to a maximum number of 3 gill tags may be issued by a distributor to a person holding a three day game fishing rod and line licence during the period 1st January to 31st May (regulation 5);
(d) providing that up to a maximum number of 6 gill tags may be issued by a distributor to a person holding a three day game fishing rod and line licence during the period 1st June to 31st October (regulation 5);
(e) providing that up to a maximum number of 5 gill tags may be issued by a distributor to a person holding a game fishing rod and line licence other than a three day game fishing rod and line licence during the period 1st January to 31st May (regulation 5);
(f) providing that up to a maximum number of 20 gill tags may be issued by a distributor to a person holding a game fishing rod and line licence other than a three day game fishing rod and line licence during the period 1st June to 31st October (regulation 5);
(g) replacing the format of the one day angling logbook prescribed in Schedule 1 with the format for a three day angling logbook (regulation 8); and
(h) making minor and consequential changes (regulations 3, 5 and 7).
