The Department of Agriculture and Rural Development[1], being a Department designated for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to measures relating to the requirement for an assessment of the impact on the environment of projects likely to have significant effects on the environment, in exercise of the powers conferred on it by the said section 2(2) and of all other powers enabling it in that behalf, hereby make the following Regulations:
Citation and commencement
1.
These Regulations may be cited as the Environmental Impact Assessment (Forestry) (Amendment) Regulations (Northern Ireland) 2007 and shall come into operation on 6th September 2007.
Amendment of the principal Regulations
2.
In regulation 18(10) of the Environmental Impact Assessment (Forestry) Regulations (Northern Ireland) 2006[3] for "the statutory maximum" there shall be substituted "level 5 on the standard scale".
Revocation
3.
The Environmental Impact Assessment (Forestry) (Amendment) Regulations (Northern Ireland) 2002 are revoked.

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations correct an error in the Environmental Impact Assessment (Forestry) Regulations (Northern Ireland) 2006 (S.R.2006 No.518) (“the 2006 Regulations“). Regulation 18(10) of those Regulations provides for the penalty for a summary offence (failure to obey a summons). That penalty is described as a fine not exceeding the statutory maximum. The appropriate maximum penalty for such offences is level 5 on the standard scale. These Regulations amend the provision accordingly. The Regulations also revoke the Environmental Impact Assessment (Forestry) (Amendment) Regulations (Northern Ireland) 2002 which amended Regulations revoked by the 2006 Regulations.
