The Department of the Environment makes the following Order in exercise of the powers conferred by Article 91C(2) of the Road Traffic Offenders (Northern Ireland) Order 1996(1).
The Department has consulted with such representative organisations as it thinks fit in accordance with Article 91F(1) of that Order.
1. This Order may be cited as the Road Traffic (Financial Penalty Deposit) (Appropriate Amount) (Amendment) Order (Northern Ireland) 2014 and shall come into operation on 31st October 2014.
2. (1) Schedule 1 to the Road Traffic (Financial Penalty Deposit) (Appropriate Amount) Order (Northern Ireland) 2012(2) (deposits for fixed penalty offences) is amended in accordance with paragraphs (2) and (3).
(2) In Table 1 (Transport Act (Northern Ireland) 1967) omit item 2.
(3) After Table 7 (the Road Traffic Regulation (Northern Ireland) Order 1997) insert-

This Order amends Schedule 1 to the Road Traffic (Financial Penalty Deposit) (Appropriate Amount) Order (Northern Ireland) 2012 to include a financial penalty deposit for using or keeping a heavy goods vehicle on a road if the HGV road user levy in respect of the vehicle has not been paid.
The Order also makes a minor amendment as a consequence of the implementation of the Goods Vehicles (Licensing of Operators) Act (Northern Ireland) 2010 by omitting item 2 and re-introducing the financial penalty deposit as item 7A.
