The Motor Vehicles (Driving Instruction) (Trainee Licence) (Amendment) Regulations (Northern Ireland) 2015

The Department of the Environment makes the following Regulations in exercise of the powers conferred by Articles 132(2), 135(1) and 218(1) of the Road Traffic (Northern Ireland) Order 1981(1).

Citation and commencement

1.  These Regulations may be cited as the Motor Vehicles (Driving Instruction) (Trainee Licence) (Amendment) Regulations (Northern Ireland) 2015 and shall come into operation on 28th February 2015.

Amendment of the Motor Vehicles (Driving Instruction) (Trainee Licence) Regulations

2.-(1) The Motor Vehicles (Driving Instruction) (Trainee Licence) Regulations (Northern Ireland) 2010(2) are amended in accordance with paragraphs (2) and (3).

(2) In regulation 7 (conditions subject to which trainee licences are granted)-

(a)in paragraph (2)-

(i)omit "and" after sub-paragraph (d); and

(ii)after sub-paragraph (e) add-

"(f)at all times when acting in accordance with these Regulations, wear the trainee licence or display the trainee licence in the motor car in such position and manner as to be plainly and distinctly visible; and

(g)not later that fourteen days after the expiry of the trainee licence, deliver said trainee licence to the person authorised by the Registrar in that behalf.";

(b)for paragraph (3) substitute-

"(3) The holder may give instruction in the driving of a motor car-

(a)only on behalf of the approved driving instructor identified in the trainee licence; and

(b)where the driving ability and fitness test has been passed in a motor car with an automatic transmission, instruction can only be given in motor cars fitted with automatic transmission.".

(3) In regulation 10 (motor car to be provided for practical part of examination)-

(a)in paragraph (3) for "The vehicle must" substitute "Subject to paragraph (3A), the motor car must";

(b)after paragraph (3) insert-

"(3A) The requirements in paragraph (3)(c) shall not apply where the Registrar is satisfied that the candidate has a disabled person's limited driving licence.".

(c)after paragraph (4) add-

"(5) In this regulation-

"disabled person's limited driving licence" means a licence of one of the following kinds-

(a)

a licence to drive a vehicle granted under Part II of the Order of 1981 (not being a provisional licence within the meaning of Part II of that Order) which is limited, by virtue of a notice served under Article 9(5)(b) of that Order, to a motor vehicle equipped with automatic transmission;

(b)

a licence to drive a vehicle granted under Part III of the Road Traffic Act 1988(3) (not being a provisional licence with the meaning of Part III of that Act) which is limited , by virtue of a notice served under section 92(5)(b) of that Act, to a motor vehicle equipped with automatic transmission: and

(c)

a community licence authorising the driving of a motor vehicle which is similarly limited by virtue of any corresponding provision of the law under which it was issued and a counterpart of that licence.".

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Motor Vehicles (Driving Instruction) (Trainee Licence) Regulations (Northern Ireland) 2010 in order to require trainee instructors to wear the trainee licence or display the trainee licence in the motor car in such position and manner as to be plainly and distinctly visible when giving instruction.

The Regulations also require the return to the Department of the Environment of an expired trainee licence within 14 days of its expiry.
