Coming into operation in accordance with Article 1
1. This Order may be cited as the Further Education (Governing Body of Institution of Further Education) Order (Northern Ireland) 2016 and shall come into operation on the day after the day on which it is affirmed by resolution of the Assembly.
2. In Schedule 3 to the Further Education (Northern Ireland) Order 1997 in paragraph 2 omit sub-paragraph (1)(e).
3. Appointments made under sub-paragraph 1(e) of paragraph 2 to Schedule 3 of the Further Education (Northern Ireland) Order 1997 before the coming into operation of this Order, shall continue to have effect.

These Regulations amend the Further Education (Northern Ireland) Order 1997 to remove the requirement on the Department for the Economy to appoint two persons nominated by the Education Authority (formerly the Education and Library Boards) to each of the Governing Bodies of the Northern Ireland Further Education Institutions. In addition, they allow for existing Education Authority appointments to continue within the confines of their terms of appointment.
The Departments Act (Northern Ireland) 2016 (2016 c.5 (N.I.))
The Departments (Transfer and Assignment of Functions) Order (Northern Ireland) 1999 (S.R. 1999 No. 481) transferred functions under the Further Education (Northern Ireland) Order 1997 to the Department of Higher and Further Education, Training and Employment, which was renamed the Department for Employment and Learning (see Department for Employment and Learning Act (Northern Ireland) 2001 (c.15 (N.I.))). The Departments (Transfer of Functions) Order (Northern Ireland) 2016 (S.R. 2016 No. 76) subsequently transferred functions under the Further Education (Northern Ireland) Order 1997 to the Department for the Economy.
