The Department of Agriculture, Environment and Rural Affairs is a Northern Ireland Department designated(1), for the purposes of section 2(2) of the European Communities Act 1972(2), in relation to the common agricultural policy of the European Community and matters relating to the promotion of rural development.
The Department of Agriculture, Environment and Rural Affairs makes the following Regulations in exercise of the powers conferred by section 2(2) of the European Communities Act 1972.
1. These Regulations may be cited as the Common Agricultural Policy Basic Payment and Support Schemes (Revocation) Regulations (Northern Ireland) 2018 and shall come into operation on 25th June 2018.
2. The Interpretation Act (Northern Ireland) 1954(3) shall apply to these Regulations as it applies to an Act of the Assembly.
3. Regulation 11 of the Common Agricultural Policy Basic Payment and Support Schemes Regulations (Northern Ireland) 2015(4) (Active Farmers) is revoked.

These Regulations amend the Common Agricultural Policy Basic Payment and Support Schemes Regulations (Northern Ireland) 2015 (S.R. 2015 No. 191) ("the 2015 Regulations"). The 2015 Regulations make provision for the implementation of the Common Agricultural Policy schemes in Northern Ireland from 2015 by providing legal definition to a number of administration arrangements established by the Department.
Article 3(3)(d) of Regulation (EU) 2017/2393 of the European Parliament and of the Council of 13 December 2017 amending Regulations (EU) No 1305/2013 on support for rural development by the European Agricultural Fund for Rural Development (EAFRD), (EU) No 1306/2013 on the financing, management and monitoring of the common agricultural policy, (EU) No 1307/2013 establishing rules for direct payments to farmers under support schemes within the framework of the common agricultural policy, (EU) No 1308/2013 establishing a common organisation of the markets in agricultural products and (EU) No 652/2014 laying down provisions for the management of expenditure relating to the food chain, animal health and animal welfare, and relating to plant health and plant reproductive material, amends Article 9 of (EU) 1307/2013 to enable the Department to discontinue the application of Article 9(2) of (EU) 1307/2013 (negative list).
Regulation 2 of these Regulations revokes regulation 11 (Active Farmers) of the 2015 Regulations which provides further clarification on the application of the common agriculture policy ‘negative list'.
A full regulatory impact assessment has not been produced for these Regulations as they have no impact on the costs of business.

1972 c. 68. Section 2(2) was amended by section 27(1)(a) of the Legislative and Regulatory Reform Act 2006 (c.51) and section 3(3) of, and Part 1 of the Schedule to, the European Union (Amendment) Act 2008 (c.7).
