Road Traffic And Vehicles

Coming into operation in accordance with regulation 1(1)
The Department for Infrastructure(1) makes the following Order in exercise of the powers conferred by Article 59(1) of the Road Traffic Offenders (Northern Ireland) Order 1996(2) and now vested in it(3).
In accordance with Article 91(1) of that Order the Department has consulted with such representative organisations as it thinks fit.
1.—(1) This Order may be cited as the Road Traffic (Fixed Penalty) (Amendment) Order (Northern Ireland) 2020 and shall come into operation on the day on which the Road Traffic Offenders (Northern Ireland) (Amendment) Order 2020(4) comes into operation.
(2) This Order applies in relation to fixed penalty offences alleged to have been committed on or after the date on which this Order comes into operation.
2. In the table in Schedule 1 (fixed penalties) to the Road Traffic (Fixed Penalty) Order (Northern Ireland) 2007(5), after item 5 insert—
“5A | A fixed penalty offence under Article 56A(b) of the Road Traffic (Northern Ireland) Order 1995(6) | £200” |

This Order amends the Road Traffic (Fixed Penalty) Order (Northern Ireland) 2007 (S.R. 2007 No. 319) to increase the fixed penalty amount for an offence under Article 56A(b) of the Road Traffic (Northern Ireland) Order 1995 (“the 1995 Order”) from £60 to £200.
Article 56A(b) of the 1995 Order relates to the offence of driving or supervising the driving of a motor vehicle while using a hand held mobile telephone, or other hand held interactive communication device or causing or permitting the driving of a motor vehicle by another person using such a telephone or other device.
