The Health Protection (Coronavirus, International Travel, Operator Liability and Information to Passengers) (Amendment No. 3) Regulations (Northern Ireland) 2021

Coming into operation

at 5.00 p.m. on 19th July 2021

The Department of Health( 1) makes the following Regulations in exercise of the powers conferred by sections 25B and 25F(2) of the Public Health Act (Northern Ireland) 1967( 2).

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Health Protection (Coronavirus, International Travel, Operator Liability and Information to Passengers) (Amendment No.3) Regulations (Northern Ireland) 2021 and shall come into operation at 5.00 p.m. on 19th July 2021.

(2) In these Regulations—

“the International Travel Regulations” means the Health Protection (Coronavirus, International Travel) Regulations (Northern Ireland) 2021( 3);

“the Passenger Information Regulations” means the Health Protection (Coronavirus, International Travel, Operator Liability and Information to Passengers) Regulations (Northern Ireland) 2021( 4).

2.  The International Travel Regulations are amended in accordance with regulation 3.

Amendments to Schedule 4

3.—(1) In Schedule 4, in Part 2 (Definitions of persons who are exempt, conditions, limitations of exemption and savings), in paragraph 66, after “amber list country” and before “(but not a red list country)” insert “, other than Metropolitan France”.

(2) In paragraphs 66(1)(d), 66(2)(c) and 66(4)(a)(iii) for “has completed a course of an authorised vaccine” substitute “meets the COVID-19 vaccination eligibility criteria for reduced self-isolation and testing requirements”.

4.  The Passenger Information Regulations are amended in accordance with regulation 5.

Amendment to regulation 4A

5.  In regulation 4A, after paragraph 7 insert—

(8)  This regulation does not apply in the case of the operator of a relevant service which commences in Metropolitan France. .

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Health Protection (Coronavirus, International Travel) Regulations (Northern Ireland) 2021 (“the International Travel Regulations”).

Regulation 3 amends the International Travel Regulations to exclude arrivals who have been in Metropolitan France in the 10 days prior to arriving in Northern Ireland from claiming the fully vaccinated traveller exemption. It also amends the wording to reflect the requirement of declaration on the Passenger Locator Form for those claiming the fully vaccinated traveller exemption.

These Regulations also amend the Health Protection (Coronavirus, Operator Liability and Information to Passengers) Regulations (Northern Ireland) 2021 (“the Passenger Information Regulations”).

Regulation 5 introduces a provision whereby regulation 4A of the Passenger Information Regulations does not apply in the case of the operator of a relevant service which commences in Metropolitan France.

No impact assessment has been prepared for these Regulations.
