Coming into operation in accordance with Article 1

The Department for Communities makes the following Order in exercise of the powers conferred by sections 89(9) and 90(2) of the Coronavirus Act 2020( 1).

Citation and commencement

1.  This Order may be cited as the Coronavirus Act 2020 (Extension of Modifications of Requirements Regarding Medical Certificates for Cremations) (No. 3) Order (Northern Ireland) 2022 and comes into operation immediately before the beginning of 25thSeptember 2022.

Extension of expiry date

2.  Section 21(1), (2) (3), (4)(a), (4)(b)(ii) and (6)(e) of the Coronavirus Act 2020 do not expire at the time when they would otherwise expire and expire instead on 24th March 2023.

Transitional Provision

3.  Section 21(2) of the Coronavirus Act 2020 has effect as if after “practitioner” there were inserted “who has attended the deceased during his last illness and”.

EXPLANATORY NOTE

(This note is not part of the Order)

Section 21 of the Coronavirus Act 2020 (“ the Act”) contains provisions modifying certain requirements regarding medical certificates for cremations.

Section 89(1) provides for the Act to expire at the end of the period of 2 years beginning with the day on which it was passed (25 March 2020). This is subject to limited exceptions, including section 21(7). Section 90 allows expiring provisions to be extended for not more than 6 months from the date they would have otherwise expired.

The Coronavirus Act 2020 (Extension of Modifications of Requirements Regarding Medical Certificates for Cremations) (No. 2) Order (Northern Ireland) 2022 ( S.R. 2022 No. 214) extended the expiry date of section 21(1) to (6) to 24 September 2022.

The Department makes this Order to extend the expiry date of section 21(1), (2), (3), (4)(a), (4)(b)(ii) and (6)(e) of the Coronavirus Act 2020 to 24 March 2023 and to manage the transition from the situation existing before the expiry of section 21(4)(b)(i), (5) and (6)(a) to (d) and that existing after they expire.
