Coming into operation-

1.—(1) These Regulations may be cited as the Further Education (Student Support) (Eligibility) (Amendment) Regulations (Northern Ireland) 2025 and come into operation on 28thFebruary 2025.
(2) Regulation 2 (amendments relating to the Ukraine Permission Extension Scheme) applies to the provision of support to a student in relation to designated courses beginning or continuing after 28thFebruary 2025.
(3) In these Regulations, “ designated course” has the meaning given by regulation 2 of the Further Education (Student Support) (Eligibility) Regulations (Northern Ireland) 2012( 3).
2.—(1) The Further Education (Student Support) (Eligibility) Regulations (Northern Ireland) 2012 are amended in accordance with paragraph (2).
(2) In Part 1 of the Schedule (eligible students: interpretation), in paragraph (1)—
(a) in the definition of “person granted leave under one of the Ukraine Schemes”( 4), after “Ukraine Extension Scheme” insert “, a person granted leave under the Ukraine Permission Extension Scheme”;
(b) after the definition of “person granted leave under the Ukraine Family Scheme” insert—
““ person granted leave under the Ukraine Permission Extension Scheme ” means a person—
who has leave to remain in the United Kingdom under the Ukraine Permission Extension Scheme; and
who has been ordinarily resident in the United Kingdom and Islands throughout the period since the person was granted such leave; ”.
3.—(1) The Further Education (Student Support) (Eligibility) (Amendment) Regulations (Northern Ireland) 2024( 5) are amended in accordance with paragraph (2).
(2) Before the heading ‘CHAPTER 1’, insert—

These Regulations amend legislation which makes provision about student support in the form of grants in respect of fees payable in connection with attendance on courses at an institution of further education.
These Regulations come into force on 28thFebruary 2025.
These Regulations include the Ukraine Permission Extension Scheme in the definition of “person granted leave under one of the Ukraine Schemes”. A definition of “person granted leave under the Ukraine Permission Extension Scheme” is also inserted.
In addition, these Regulations amend the Further Education (Student Support) (Eligibility) (Amendment) Regulations (Northern Ireland) 2024 to insert wording confirming the Regulations to be amended.
A regulatory impact assessment has not been produced for this rule as no, or no significant impact on the private, voluntary or public sectors is foreseen.
Formerly the Department for Employment and Learning; see Article 6(1)(c) of the Departments (Transfer of Functions) Order (Northern Ireland) 2016 ( S.R. 2016 No. 76). Article 5(b) and Part II of Schedule 3 to the Departments (Transfer and Assignment of Functions) Order (Northern Ireland) 1999 ( S.R. 1999 No. 481) transferred functions under the Education (Student Support) (Northern Ireland) Order 1998 from the Department of Education to the Department of Higher and Further Education, Training and Employment. The Department of Higher and Further Education, Training and Employment was renamed the Department for Employment and Learning by 2001 c.15 (N.I.), section 1, and following the dissolution of that department by the Departments Act (Northern Ireland) 2016 (c.5 (N.I.)), section 1(10), its functions under the Education (Student Support) (Northern Ireland) Order 1998 were transferred to the Department for the Economy by S.R. 2016 No. 76, Article 6(1)(c).
S.I. 1998/1760 (N.I. 14), articles 3(1) and (2) were amended by the Learning and Skills Act 2000 (c.21), section 147(3)(a) and (b) respectively.
the definition of “person granted leave under one of the Ukraine Schemes” was inserted by S.R 2022 No. 183.
