Subject_Proof.—
Absolvitor from an action of damages for defamation, in respect of defective proof.
James Downie raised an action of damages, for defamation, against Janet Mill, before the Sheriff of Perth. On considering the import of a proof, the Sheriff awarded £5, 5s. of damages and expenses. Mill brought an advocation, and the Lord Ordinary taking an opposite view of the proof, advocated the cause, and assoilzied her with expenses. Downie reclaimed, but the Court unanimously adhered.
