Scott

v.

Campbell

No. 189

Court of Session

1st Division

May 31 1838

Lord Cuniughame. N.

Thomas Scott,     Pursuer.— Counsel:
Sol.—Gen. Rutherfurd— Pyper.
Walter Frederick Campbell,     Defender.— Counsel:
D. F. Hope— Fletcher.
William Scott,     Defender.— Counsel:
Maitland— Patton.

Subject_Process—Reparation.— Headnote:

This was a case of a special nature. Thomas Scott, farmer in Townhead, raised a reduction of certain decrees of removing pronounced by the Sheriff of Lanarkshire, and also concluding for damages. The Lord Ordinary assoilzied the defenders, with expenses, and the Court unanimously adhered.

The Lord Ordinary, in the note subjoined to his interlocutor, specially directed certain documents, besides the record, to be appended to any reclaiming note which the pursuer might present, as it seemed proper that these documents should be specially under the view of the Court. This was done by the reclaimer.

Solicitors: J. J. Smith, S.S.C.— J. M'Innes, S.S.C.— D. Christie, S.S.C.—Agents.
