INQUIRY HELD UNDER FATAL ACCIDENTS AND SUDDEN DEATHS INQUIRY (SCOTLAND) ACT 1976

 

CERTIFIED COPY DETERMINATION BY BRIAN A MURPHY Esquire, Sheriff of the Sheriffdom of North Strathclyde following an Inquiry held at Kilmarnock on the Fifteenth day of January Two Thousand and Ten into the death of James Lamont Jack, born 21 December 1967, who resided at Greenhills Farm, Beith, Ayrshire.

 

 

 

KILMARNOCK: 15 January 2010

 

The Sheriff, having considered all the evidence adduced, DETERMINES:

 

1.      In terms of section 6(1)(a) of the Fatal Accidents and Sudden Deaths Inquiry (Scotland) Act 1976 that James Lamont Jack, born 21st December 1967 and who latterly resided at Greenhills Farm, Beith Ayrshire, died at 16:00 hours on 17th March 2009 at Crosshouse Hospital, Kilmarnock, Ayrshire.

 

2.      In terms of section 6(1)(b) of the Act that the cause of his death was a) Pulmonary thrombo embolism b) Immobility and recent surgery c) Fracture dislocation of right ankle d) Accident at work, he having broken his ankle being self employed as a farmer at Greenhills Farm, Beith, Ayrshire.

 

3.      In terms of section 6(1)(c) of the Act that there were no reasonable

Precautions whereby the death might have been avoided.

 

4.      In terms of section 6(1)(d) of the Act that there were no defects in any

system of working which contributed to the death.
