The Scottish Ministers, in exercise of the powers conferred by sections 8(1), 9(3) and 28(4) of the Regulation of Investigatory Powers (Scotland) Act 2000[1], hereby make the following Order: Citation, commencement and interpretation 1. This Order may be cited as the Regulation of Investigatory Powers (Prescription of Offices, Ranks and Positions) (Scotland) Amendment Order 2001 and shall come into force on 1st April 2001. Amendment of the Regulation of Investigatory Powers (Prescription of Offices, Ranks and Positions) (Scotland) Order 2000 2. In the Schedule to the Regulation of Investigatory Powers (Prescription of Offices, Ranks and Positions) (Scotland) Order 2000[2], in column 1, for "The Scottish Crime Squad" there is substituted "The Operational and Intelligence Group of the Scottish Drug Enforcement Agency". JAMES WALLACE A member of the Scottish Executive St Andrew's House, Edinburgh 8th March 2001 EXPLANATORY NOTE (This note is not part of the Order) This Order amends the Regulation of Investigatory Powers (Prescription of Offices, Ranks and Positions) (Scotland) Order 2000 which prescribes offices, ranks and positions for the purposes of section 8(1) of the Regulation of Investigatory Powers (Scotland) Act 2000 (asp 11) ("the 2000 Act"), under which individuals holding such offices, ranks or positions are designated persons for the purposes of granting authorisations under sections 6 and 7 of the 2000 Act. The amendment made is to delete the reference to the Scottish Crime Squad as a relevant public authority and to substitute a reference to the Operational and Intelligence Group of the Scottish Drug Enforcement Agency which is to replace the Scottish Crime Squad on 1st April 2001 (article 2). [1] 2000 asp 11; see the definition of the "Scottish Crime Squad" in section 9(1) which includes any other joint operation established by agreement under section 12 of the Police (Scotland) Act 1967 and which fulfils purposes most or all of which consist of or include purposes which are the same as or similar to those fulfilled by the Scottish Crime Squad.back
