NATIONAL HEALTH SERVICE

The Argyll and Clyde National Health Service Trusts (Dissolution) Order 2003

  Made 24th June 2003 
  Coming into force 1st July 2003 

The Scottish Ministers, in exercise of the powers conferred by sections 12A(1) and 105(6) of and paragraph 25(1) of Schedule 7A to the National Health Service (Scotland) Act 1978[1] and of all other powers enabling them in that behalf, having received an application[2] from each of the National Health Service trusts specified in Schedule 1 to this Order, and after completion of the consultation prescribed[3] under paragraph 25(3) of the said Schedule 7A, hereby make the following Order:

Citation and commencement
     1. This Order may be cited as the Argyll and Clyde National Health Service Trusts (Dissolution) Order 2003 and shall come into force on 1st July 2003.

Dissolution of NHS Trusts
    
2. The National Health Service trusts specified in Schedule 1 to this Order are hereby dissolved.

Revocations
    
3. The Orders specified in Schedule 2 to this Order are hereby revoked.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order provides by article 2 for the dissolution on 1st July 2003 of the three National Health Service trusts detailed in Schedule 1. As a consequence of those dissolutions this Order also revokes the Orders establishing those trusts and Orders amending those establishment Orders, which are all detailed in Schedule 2.

[1] 1978 c.29; section 12A(1) was inserted by the National Health Service and Community Care Act 1990 (c.19) ("the 1990 Act"), section 31 and extended and amended by the Health Act 1999 (c.8), section 46; Schedule 7A was inserted by the 1990 Act, Schedule 6. The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c.46).back
