TRIBUNALS AND INQUIRIES

The Tribunals and Inquiries (Dairy Produce Quota Tribunal) (Scotland) Order 2004

  Made 10th March 2004 
  Laid before the Scottish Parliament 11th March 2004 
  Coming into force 1st April 2004 

The Scottish Ministers, in exercise of the powers conferred by section 13(1) and (5)(a) of the Tribunals and Inquiries Act 1992[1], hereby make the following Order:

Citation, commencement and extent
     1.  - (1) This Order may be cited as the Tribunals and Inquiries (Dairy Produce Quota Tribunal) (Scotland) Order 2004 and shall come into force on 1st April 2004.

    (2) This Order extends to Scotland only.

Amendment of the Tribunals and Inquiries Act 1992
    
2. In Part II of Schedule 1 (Tribunals Under Supervision of Scottish Committee) to the Tribunals and Inquiries Act 1992, for paragraph 49 substitute-

EXPLANATORY NOTE

(This note is not part of the Order)


This Order brings the Dairy Produce Quota Tribunal for Scotland under the supervision of the Scottish Committee of the Council on Tribunals by amending the Tribunals and Inquiries Act 1992. The Dairy Produce Quotas Tribunals were re-constituted by the Dairy Produce Quotas (General Provisions) Regulations 2002, regulation 7 and the Schedule to those Regulations.

The functions of the Lord Advocate under section 13 were transferred to the Secretary of State by article 2(1) of, and the Schedule to, the Transfer of Functions (Lord Advocate and Secretary of State) Order 1999 (S.I. 1999/678). Section 13(5)(a) was amended by section 151 of, and Schedule 5 paragraph 16(4) to, the Pensions Act 1995 (c.26) and section 177 of, and Schedule 7, Part III to, that Act and article 337 of the Financial Services and Markets Act 2000 (Consequential Amendments and Repeals) Order 2001 (S.I. 2001/3649). The functions of the Secretary of State were transferred, in so far as they are exercisable in or as regards Scotland, to the Scottish Ministers, by article 2 of, and Schedule 1 to, the Scotland Act 1998 (Transfer of Functions to Scottish Ministers etc.) Order 1999, S.I. 1999/1750.back
