The Glasgow School of Art (Scotland) Amendment Order of Council 2005

  Made 25th October 2005 
  Laid before the Scottish Parliament 4th November 2005 
  Coming into force 28th November 2005 

Their Lordships, in exercise of the powers conferred upon Them by sections 45 and 60 of the Further and Higher Education (Scotland) Act 1992[1] and of all other powers enabling Them in that behalf, are pleased to order, and it is hereby ordered, as follows:

Citation, commencement and application
     1. This Order may be cited as the Glasgow School of Art (Scotland) Amendment Order of Council 2005 and shall come into force on 28th November 2005 but articles 2(4), 2(5) and 2(7) shall not apply to Governors elected prior to 6th May 2003.

Amendment of the Glasgow School of Art (Scotland) Order of Council 1996
    
2. —(1) The Glasgow School of Art (Scotland) Order of Council 1996[2] is amended as follows.

    (2) In articles 3(1)(c)(i), 3(1)(c)(ii), 3(1)(c)(iii), 4(1)(a), 4(1)(b), 4(2) and 9(e), and in paragraphs 1(b) and 2(b) of Schedule 1, in each place where it occurs, omit "full-time".

    (3) In articles 3(1)(c)(iii), 4(1)(b), 4(2) and 9(e) for "non-academic" in each place where it occurs, substitute "support".

    (4) In article 6(3) (period of office of governors) for "12" substitute "9".

    (5) In article 6(5)(a) for "4", and in paragraphs 2(d) and 3 of Schedule 1 for "four", substitute "3".

    (6) In article 7 (age limit for governors) for "70" substitute "68".

    (7) In article 9(d) (vacation of office of governors) for "a period longer than six consecutive months" substitute "four or more consecutive meetings".

    (8) In paragraph 1(a) of Schedule 1 after "Association" insert ", Director of Digital Design Studio, Head of Academic and Student Services, Head of Research and Postgraduate Studies,".

    (9) In paragraph 2(c) of Schedule 1 after "Governors" insert ", so that the term of office for elected members of the council commences on 1st October immediately following the date of the election".

EXPLANATORY NOTE

(This note is not part of the Order)


This Order of Council amends The Glasgow School of Art (Scotland) Order of Council 1996 (S.I. 1996/120) ("the 1996 Order"). The 1996 Order makes provision for the constitution, functions and powers of the Governors of The Glasgow School of Art ("the School"), as governing body of the School, and the arrangements to be adopted by it in discharging its functions.

The School is an institution designated by Scottish Ministers as eligible to receive support from the Scottish Higher Education Funding Council. The School is also a fundable body eligible to receive support from the Scottish Further and Higher Education Funding Council under the Further and Higher Education (Scotland) Act 2005 (asp 6). The School is a company incorporated under the Companies Acts and the powers and duties of the company are specified in the company's Memorandum and Articles of Association.

The 1996 Order is amended by article 2(2) to provide that all employees, whether full-time or part-time, shall be eligible to vote and to stand for election to serve as Governors of the School.

Paragraph (3) replaces the term ‘non-academic' staff with the term ‘support' staff.

Paragraph (4) provides for a reduction of the aggregate permitted term in office as a Governor from twelve years to nine years.

Paragraph (5) provides for a reduction in the permitted length of individual terms of office as a Governor from four years to three years.

Paragraph (6) provides for a reduction in the age limit for Governors from 70 years to 68 years.

Paragraph (7) provides for a Governor's place to be declared vacant if that Governor has failed to attend four or more consecutive meetings of the Governors, or any of their committees or sub-committees, otherwise than for a reason approved by the Governors.

Paragraphs (4), (5) and (7) shall not apply to those Governors elected prior to 6th May 2003.

Paragraph (8) amends Schedule 1 to reflect changes which have been made to the senior management structure of the School by adding the Director of Digital Design Studio, Head of Academic and Student Services, and Head of Research and Postgraduate Studies to those posts whose holders qualify as ex officio members of the Academic Council.

Paragraph (9) amends Schedule 1 to reflect the pattern of the academic year by providing that elected members of the Academic Council commence their term of office on 1st October.
