The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 237 and 330 of the Housing (Scotland) Act 1987(1) and all other powers enabling them to do so.
1. These Regulations may be cited as the Housing Grants (Application Forms) (Scotland) Amendment Regulations 2008 and come into force on 27th October 2008.
2. The Housing Grants (Application Forms) (Scotland) Regulations 2003(2) are amended in accordance with regulations 3 to 6.
3. In Schedule 1-
(a) in parts D2 and D(A)2 of the form of the Application for Improvement Grant not relating to works for a disabled occupant, for "Income support" substitute-
"Income support or income related employment and support allowance"; and
(b) in parts D13a and D(A)13a of the form of the Application for Improvement Grant not relating to works for a disabled occupant, for "Incapacity Benefit" substitute-
"Incapacity Benefit or contributory employment and support allowance".
4. In Schedule 2-
(a) in part D2 of the form of the Application for Improvement Grant relating to works for a disabled occupant, for "Income support" substitute-
"Income support or income related employment and support allowance"; and
(b) in part D13a of the form of the Application for Improvement Grant relating to works for a disabled occupant, for "Incapacity Benefit" substitute-
"Incapacity Benefit or contributory employment and support allowance".
5. In Schedule 3-
(a) in parts D2 and D(A)2 of the form of the Application for Repairs Grant, for "Income support" substitute-
"Income support or income related employment and support allowance"; and
(b) in parts D13a and D(A)13a of the form of the Application for Repairs Grant, for "Incapacity Benefit" substitute-
"Incapacity Benefit or contributory employment and support allowance".
6. In Schedule 4-
(a) in parts D2 and D(A)2 of the form of the Application for Grant for a means of escape from fire in a house in multiple occupation, for "Income support" substitute-
"Income support or income related employment and support allowance"; and
(b) in parts D13a and D(A)13a of the form of the Application for Grant for a means of escape from fire in a house in multiple occupation, for "Incapacity Benefit" substitute-
"Incapacity Benefit or contributory employment and support allowance".

These Regulations amend the application forms for improvement grant not relating to works for a disabled occupant, for improvement grant relating to works for a disabled occupant, for repairs grant and for grant for a means of escape from fire in a house in multiple occupation in the Housing Grants (Application Forms) (Scotland) Regulations 2003.
The application forms are amended to add income related employment and support allowance and contributory employment and support allowance to the lists of benefits in various parts of the forms (regulations 2 to 6).
1987 c. 26. Section 237 was amended by the Housing (Scotland) Act 2001 (asp 10), section 97. See section 338 of the Housing (Scotland) Act 1987 (c. 26) for the definition of "prescribed".
