The Scottish Ministers make the following Order in exercise of the powers conferred by paragraph 7 of Schedule 1 to the Town and Country Planning (Scotland) Act 1997(1) and all other powers enabling them to do so.
In accordance with paragraph 9 of Schedule 1 to that Act they have consulted the Highland Council.
1.-(1) This Order may be cited as the Town and Country Planning (Continuation in force of Local Plans) (Highland) (Scotland) Order 2012 and comes into force on 1st April 2012.
(2) In this Order, "new site specific land allocation" means a proposal contained in the Highland-wide Local Development Plan(2) which allocates land for development, or a class of development, by reference to a specific site or area of land described in that local development plan.
2.-(1) The Scottish Ministers direct that, notwithstanding the adoption of the Highland-wide Local Development Plan, the specified provisions of-
(a)the Inverness Local Plan(3);
(b)the Nairnshire Local Plan(4);
(c)the Ross and Cromarty East Local Plan(5);
(d)the Sutherland Local Plan(6);
(e)the Caithness Local Plan(7);
(f)the West Highland and Islands Local Plan(8);
(g)the Wester Ross Local Plan(9); and
(h)the Badenoch and Strathspey Local Plan(10),
shall continue in force in relation to the area to which the Highland-wide Local Development Plan relates.
(2) In this article the "specified provisions" in relation to a local plan means the provisions specified in column 1 of the Part of the Schedule relating to that plan-
(a)subject, as the case may be, to any limitation or exclusion relating to those provisions specified in the corresponding entry in column 2; and
(b)other than any reference within those provisions to another provision which is not continued in force by this Order.

This Order continues in force certain provisions of the existing local plans for the Highland area notwithstanding the adoption of the Highland-wide Local Development Plan. The provisions of-
(a)the Inverness Local Plan;
(b)the Nairnshire Local Plan;
(c)the Ross and Cromarty East Local Plan;
(d)the Sutherland Local Plan;
(e)the Caithness Local Plan;
(f)the West Highland and Islands Local Plan;
(g)the Wester Ross Local Plan; and
(h)the Badenoch and Strathspey Local Plan,
specified in column 1 of the Schedule are continued in force subject to any limitation or exclusion set out in column 2 or referred to in article 2(2)(b).
1997 c.8. The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c.46). Paragraph 7 of Schedule 1 was amended by section 53(7) of the Planning etc. (Scotland) Act 2006 (asp 17).
The proposed Highland-wide Local Development Plan was published, and the Highland Council's intention to adopt it was advertised, on 7th March 2012 in accordance with section 19(10) of the Town and Country Planning (Scotland) Act 1997 (c.8). The proposed Highland-wide Local Development Plan and the local plans specified in article 2(1) can be viewed at http://www.highland.gov.uk/yourenvironment/planning/developmentplans/ and at the main office of The Highland Council, Glenurquhart Road, Inverness IV3 5NX.
The Inverness Local Plan was adopted by The Highland Council on 2nd March 2006.
The Nairnshire Local Plan was adopted by The Highland Council on 21st December 2000.
The Ross and Cromarty East Local Plan was adopted by The Highland Council on 8th February 2007.
The Sutherland Local Plan was adopted by The Highland Council on 24th June 2010.
The Caithness Local Plan was adopted by The Highland Council on 12th September 2002.
The West Highland and Islands Local Plan was adopted by The Highland Council on 9th September 2010.
The Wester Ross Local Plan was adopted by The Highland Council on 29th June 2006.
The Badenoch and Strathspey Local Plan was adopted by The Highland Council on 11th September 1997.

This Order continues in force certain provisions of the existing local plans for the Highland area notwithstanding the adoption of the Highland-wide Local Development Plan. The provisions of-
(a)the Inverness Local Plan;
(b)the Nairnshire Local Plan;
(c)the Ross and Cromarty East Local Plan;
(d)the Sutherland Local Plan;
(e)the Caithness Local Plan;
(f)the West Highland and Islands Local Plan;
(g)the Wester Ross Local Plan; and
(h)the Badenoch and Strathspey Local Plan,
specified in column 1 of the Schedule are continued in force subject to any limitation or exclusion set out in column 2 or referred to in article 2(2)(b).
1997 c.8. The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c.46). Paragraph 7 of Schedule 1 was amended by section 53(7) of the Planning etc. (Scotland) Act 2006 (asp 17).
The proposed Highland-wide Local Development Plan was published, and the Highland Council's intention to adopt it was advertised, on 7th March 2012 in accordance with section 19(10) of the Town and Country Planning (Scotland) Act 1997 (c.8). The proposed Highland-wide Local Development Plan and the local plans specified in article 2(1) can be viewed at http://www.highland.gov.uk/yourenvironment/planning/developmentplans/ and at the main office of The Highland Council, Glenurquhart Road, Inverness IV3 5NX.
The Inverness Local Plan was adopted by The Highland Council on 2nd March 2006.
The Nairnshire Local Plan was adopted by The Highland Council on 21st December 2000.
The Ross and Cromarty East Local Plan was adopted by The Highland Council on 8th February 2007.
The Sutherland Local Plan was adopted by The Highland Council on 24th June 2010.
The Caithness Local Plan was adopted by The Highland Council on 12th September 2002.
The West Highland and Islands Local Plan was adopted by The Highland Council on 9th September 2010.
The Wester Ross Local Plan was adopted by The Highland Council on 29th June 2006.
The Badenoch and Strathspey Local Plan was adopted by The Highland Council on 11th September 1997.
