The Scottish Ministers make the following Order in exercise of the powers conferred on them by section 129(2) and (3) of the Police and Fire Reform (Scotland) Act 2012(1).

Citation, commencement and interpretation

1.-(1) This Order may be cited as the Police and Fire Reform (Scotland) Act 2012 (Commencement No. 4, Transitory and Transitional Provisions) Order 2013 and comes into force on 1st April 2013.

(2) In this Order "the Act" means the Police and Fire Reform (Scotland) Act 2012.

Appointed day

2. 1st April 2013 is the day appointed for the coming into force of the Act, so far as not already in force.

Annual reports

3. Despite the coming into force of section 39 of the Act (the Scottish Police Authority's annual report), the Authority is not required to produce an annual report for the reporting year ending on 31st March 2013.

Modification of schedule 7 to the Act

4.-(1) Paragraph (2) has effect until the date on which section 19 of the Road Safety Act 2006(2) comes into force in relation to Scotland.

(2) Paragraph 54 of schedule 7 to the Act (minor and consequential amendments) is to be read as if there were substituted for it-

"In section 87 of the Road Traffic Regulation Act 1984 (exemption of fire, ambulance and police vehicles from speed limits), for "a relevant authority (as defined in section 6 of the Fire (Scotland) Act 2005 (asp 5))" substitute "the Scottish Fire and Rescue Service"."

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force on 1st April 2013 the provisions of the Police and Fire Reform (Scotland) Act 2012 ("the Act"), to the extent that those provisions are not already in force.

Section 39 of the Act requires the Scottish Police Authority to produce an annual report in respect of each yearly period ending on 31st March. Article 3 of this Order provides that the Authority is not required to produce such a report in respect of the year ending 31st March 2013.

Paragraph 54 of schedule 7 to the Act makes an amendment to section 87(1) of the Road Traffic Regulation Act 1984 as it is to be amended by section 19 of the Road Safety Act 2006. Section 19 will not be in force when paragraph 54 of schedule 7 comes into force, so article 4 of this Order makes transitory provision modifying the amendment made by that paragraph until section 19 comes into force in Scotland.
