The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 182 of the Town and Country Planning (Scotland) Act 1997(1) and all other powers enabling them to do so.
1. These Regulations may be cited as the Town and Country Planning (Control of Advertisements) (Scotland) Amendment (No. 2) Regulations 2014 and come into force on 10th November 2014.
2. (1) The Town and Country Planning (Control of Advertisements) (Scotland) Regulations 1984(2) are amended in accordance with paragraph (2).
(2) In Schedule 4 (the specified classes of advertisements displayed with deemed consent), after Class VI (illuminated advertisements) insert-
(a)in the first column (description of advertisement)-
"Class VII: |
Advertisements on ground based housing for electronic communications apparatus: |
Advertisements displayed on ground based housing for electronic communications apparatus required to be attached to that housing by virtue of Articles 8 and 9 of Commission Regulation (EC) No 1828/2006 setting out rules for the implementation of Council Regulation (EC) No 1083/2006 laying down general provisions on the European Regional Development Fund, the European Social Fund and the Cohesion Fund and of Regulation (EC) No 1080/2006 of the European Parliament and of the Council on the European Regional Development Fund(3)." |
(b)in the second column (maximum height of letters or figures)-
"0.1 metre"; |
(c)in the third column (maximum height above ground level of highest part of advertisement)-
"1.5 metres"; and |
(d)in the fourth column (other conditions)-
"Area of advertisement not to exceed 0.3 square metres.". |

These Regulations amend the Town and Country Planning (Control of Advertisements) (Scotland) Regulations 1984 ("the principal Regulations"). They insert a new class of advertisement for which consent is deemed to be granted under regulation 10 of the principal Regulations. The advertisements will be placed on ground based electronic communications apparatus housing to publicise the fact that the project to which the apparatus relates has had the benefit of funding from European Union Structural Funds.
1997 c.8. The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c.46). There are amendments to section 182 which are not relevant to these Regulations.
