The Scottish Ministers make the following Order in exercise of the powers conferred by section 45(2) of the Procurement Reform (Scotland) Act 2014(1).

Citation and commencement

1.  This Order may be cited as the Procurement Reform (Scotland) Act 2014 (Commencement No. 2) Order 2015 and comes into force on 11th January 2016.

Interpretation

2.  In this Order, "the Act" means the Procurement Reform (Scotland) Act 2014.

Appointed day

3.  The day appointed for the coming into force of sections 10, 13, 20 and 26 of the Act is 11th January 2016.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings certain provisions of the Procurement Reform (Scotland) Act 2014 into force.

Section 10 covers guidance on sustainable procurement duty.

Section 13 covers guidance on procurements for health or social care services.

Section 20 covers guidance on the preparation and publication of procurement strategies and annual procurement reports.

Section 26 covers guidance on community benefit requirements.

Sections 41, 42, 43, 44, 45 and 46 came into force on 17th June 2014 (the day of Royal Assent).

NOTE AS TO EARLIER COMMENCEMENT ORDERS

The following provisions of the Act have been brought into force to enable the Scottish Ministers to publish guidance about the selection of economic operators and the award of contracts in relation to a regulated procurement by a commencement order made before the date of this Order:-

2014 asp 12. Section 8 of the Interpretation and Legislative Reform (Scotland) Act 2010 (asp 10) allows the power to be exercised so as to appoint different days for different purposes.
