The Scottish Ministers make the following Regulations in exercise of the powers conferred by Article 4(2) of Council Regulation (EU) No. 1370/2013of 16 December 2013 determining measures on fixing certain aids and refunds related to the common organisation of the markets in agricultural products( 1), Articles 18 and 20 of Regulation (EU) No. 1308/2013of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No. 922/72, (EEC) No. 234/79, (EC) No. 1037/2001and (EC) No. 1234/2007(“ the CMO Regulation”)( 2) and all other powers enabling them to do so.

In accordance with Article 18(1) and (2)( 3) of the CMO Regulation, the Scottish Ministers have taken into account the need to respond in a timely way to a particularly difficult market situation or economic developments having a significant negative impact on the margins in the sector.

Citation, commencement and extent

1.—(1) These Regulations may be cited as the Private Storage Aid Scheme (Pigmeat) (Scotland) Amendment Regulations 2021 and come into force on 15 January 2022.

(2) These Regulations extend to Scotland.

Interpretation

2.—(1) The Private Storage Aid Scheme (Pigmeat) (Scotland) Regulations 2021( 4) are amended in accordance with paragraphs (2) and (3).

(2) In regulation 4(1)(c) (procedure to be followed), for “28 February” substitute “31 March”.

(3) In the schedule, for Table 2 substitute—

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Private Storage Aid Scheme (Pigmeat) (Scotland) Regulations 2021 (“ the principal Regulations”), which grant private storage aid for pigmeat under powers conferred by Articles 18 and 20 of Regulation (EU) No. 1308/2013of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products. Regulation (EU) No. 1308/2013is retained EU law, as defined in section 6(7) of the European Union (Withdrawal) Act 2018 (c. 16). These Regulations come into force on 15 January 2022.

Regulation 2 amends the principal Regulations by changing the date by which applications must be made from 28 February 2022 to 31 March 2022 and by inserting a new Table 2 into the schedule. The new Table 2 includes middle and loin cuts (bone in) under CN Code ex 0203 19 15 and loins, with or without neck-ends or chumps (bone out) and middles (bone out) under CN Code ex 0202 19 55.

A Business and Regulatory Impact Assessment has not been produced for this instrument as no, or no significant, impact on business, charities or voluntary bodies is foreseen.

EUR 2013/1308 (“ the CMO Regulation”) was incorporated into domestic law on IP completion day by section 3 of the European Union (Withdrawal) Act 2018 (c. 16). The CMO Regulation was relevantly amended by S.I. 2019/821and S.I. 2019/831, and is modified by section 12 and schedule 1 of the Agriculture (Retained EU Law and Data) (Scotland) Act 2020 (asp 17). The term “ appropriate authority” in relation to Scotland means the Scottish Ministers as per Article 3(5)(c) of the CMO Regulation.
