    NOTICE OF WITHDRAWAL OF APPEAL BY THE APPELLANT

     

     

    1.                  Following a hearing on 15th November 2013 the determination of First-tier Tribunal Judge Scott-Baker was set aside and the appeal listed for a resumed hearing limited to considering the issue of the existence or otherwise of a durable relationship on the 17th February 2014.

     

    2.                  On the 20th January 2014 the Tribunal received a letter from Mitchell Simmonds Solicitors advising that the Appellant has instructed them that she no longer wishes to pursue the appeal, has made afresh application to the Home Officer, and that she seeks to withdraw the appeal. The following directions/orders shall therefore apply:

     

    i. Leave granted to the Appellant to withdraw the appeal.

     

    ii. The hearing listed at Field House on Monday 17th February 2014 be vacated.

     

    iii. Following the withdrawal of the appeal there is no longer anything extant upon which the Upper Tribunal is required to make a decision. The case is concluded.
