NOTICE OF WITHDRAWAL PURSUANT TO RULE 17 OF THE 2008 PROCEDURE RULES
1. The respondent is Mr Yongfu Jiang. He is a citizen of China and his date of birth is 17th November 1977. I shall refer to him as the appellant as he was before the FtT.
2. The appellant has been in the UK since January 2001. He made an application under the long residence Rules which was refused by the Secretary of State on 7th March 2014. He appealed against the decision and his appeal was allowed by Judge of the First-tier Tribunal Griffiths on the grounds that the decision was not in accordance with the law.
3. The Secretary of State submitted grounds seeking permission to appeal and permission to appeal was granted by Judge of the First-tier Tribunal Nicholson on 23rd January 2015.
4. At the hearing before me Mr Jarvis representing the Secretary of State made an application orally to withdraw the Secretary of State's case. There was no objection to this by Mr Toal. I consented to the withdrawal the Secretary of State's case.
