NOTICE OF WITHDRAWAL

 

 

1. Ms Fijiwala sought to withdraw the Secretary of State's appeal against decision by First-tier Tribunal Judge Lenier allowing the appeal of the respondent under the 2006 EEA Regulations.

2. Consent of the Upper Tribunal is required for a party to withdraw its case. Accordingly, with my consent, and pursuant to rule 17(5) of the Tribunal Procedure (Upper Tribunal) Rules 2008, this appeal is recorded as "Withdrawn with the consent of the Upper Tribunal".

 

3. The effect of this is that the proceedings before the Upper Tribunal are at end. There is no appeal before the Upper Tribunal and the decision of the First-tier Tribunal in relation to this respondent shall stand.
