DECISION AND REASONS

1.              The Secretary of State has by letter dated 26 June 2018 accepted that the error of law alleged by the appellant has been made out and that having agreed to the matter being heard de novo does not object to the matter being remitted to the First-tier Tribunal for a remaking of the decision.

2.              Having regard to the nature of the error and the need for further evidence to be heard, my preliminary view is that the course proposed by the respondent is appropriate.

3.              Unless the appellant proposes an alternative course within fourteen days of the date of the sending out of these directions, this decision will stand as the decision in the appeal by the appellant before the Upper Tribunal whereby, with the consent of the Secretary of State, the decision of the First-tier Tribunal is set aside and the appeal remitted to the First-tier Tribunal for its further consideration.

4.              No anonymity direction is made.
