Appellant: Mr Hussain, Counsel
Respondent: Mr McVeety, Senior Home Office Presenting Officer
DECISION AND REASONS
At the beginning of the hearing Mr McVeety conceded that the appellant's appeal must be allowed on international protection and human rights grounds on the basis that the SSHD accepted that the application of the country guidance in AAR (OLF - MB confirmed) Ethiopia CG [2022] UKUT 1 (IAC) to the facts accepted by the First-tier Tribunal, are such that this appellant falls in a relevant risk category and is at risk of persecution for reasons relating to his imputed political opinion. Mr McVeety was entirely correct to make that concession for the reasons he outlined, and I accept the SSHD's concession. The appellant has been detained in the past in Ethiopia because of suspicions as to his links with the OLF and the country guidance entirely supports Mr McVeety's concession that there is a real risk this will be repeated upon his return to Ethiopia.
Decision
I remake the decision by allowing the appellant's appeal on international protection and human rights grounds.

Ms M. Plimmer
Judge of the Upper Tribunal
