    JUDGE PETER CLARK: This is an appeal against the Industrial Tribunal's decision that the Respondent's complaint of victimisation under the Sex Discrimination Act is in part well-founded. It is not entirely clear to us precisely what finding of victimisation was made by the Industrial Tribunal, looking at their extended reasons dated 28 October 1997.

    Further, Mr Wallington takes points on the causal link between a protected act and an act of less favourable treatment, whatever that may have been in the mind of the Tribunal.

    In all the circumstances we are satisfied that this appeal does raise an arguable point of law which ought to go forward to a full hearing.

    The case will be listed Category B; "not before 11.30 am". There will be an exchange of skeleton arguments between the parties not less than 14 days before the date fixed for the full appeal hearing. Copies of those skeletons to be lodged with this Appeal Tribunal at the same time.

    We have considered Mr Wallington's application for extracts from the Chairman's notes of evidence. We reject it. There will be no order for Chairman's notes.
