MR JUSTICE BELL: We have decided that this matter should be allowed to proceed to a full appeal hearing, but we have so decided because of a point which was not at all apparent to us from the reading of the Notice of Appeal. It is the point which is covered in paragraphs 6.3 to 6.7 particularly of Mr Ford's skeleton argument dated 15 March 1998.
We give leave for the Notice of Appeal to be amended to make it quite clear just what the point is which is being taken and, in any event, to remove the second ground of appeal which is no longer to be pursued.
There should be exchange of skeleton arguments, not less than 28 days before the appeal hearing and the matter should be listed for half a day, Category C.
