    JUDGE WILKIE QC: This is an appeal by Mrs Webster against the decision of the Employment Tribunal sitting at Liverpool that her claim for unfair constructive dismissal failed.

  1. This is a case in which the tribunal have set out their findings of fact involving a chronology of events and the tribunal's interpretation of those events. The tribunal come to a conclusion, applying the correct legal approach on findings of fact, which, on the face of the decision, they were entitled to come to in matters where there was a conflict of evidence.
  2. In essence, the appeal of Mrs Webster simply takes issue with those findings of fact on the basis that the tribunal should have believed her and should not have believed the witnesses for the respondent insofar as that evidence was preferred by the tribunal.
  3. In our judgment, this falls very far short of being a case, which presents a reasonably arguable point, whether in law, or on the grounds of perversity. Therefore we dismiss this appeal at this stage without the need for a full hearing of the appeal.
