PRELIMINARY HEARING
For the Appellant | Ms A Whyte (of Counsel) Messrs Weightmans Solicitors 79/83 Colmore Row Birmingham B3 2AP |
JUDGE H WILSON: This has been a preliminary hearing of a Notice of Appeal which was dated the 5 November 1998, concerning an Employment Tribunal Decision promulgated on 28 September 1998. The Notice of Appeal has been supported by a skeleton argument which develops the points made and which was received by this Tribunal on 22 January 1999.
We are satisfied that the matter should go forward to a full hearing on the following questions. Whether the Employment Tribunal erred in law:
(1) In failing to state what facts it found proved;
(2) In further failing to relate findings of fact to the appropriate statutory provisions; and
(3) In failing to give reasons for its findings and its decision.
On those three questions only, we think there should be a full hearing.
Category C. Time Estimate 2 hours.
