MR JUSTICE MORISON (PRESIDENT): This is a meeting for directions.

  1. The Appellant has unfortunately died. There is therefore a question which arises as to whether the person named in her will is capable of maintaining these proceedings or not. In the light of a decision of the Employment Appeal Tribunal recently, it would appear that the person concerned cannot maintain these proceedings but leave to appeal was given in that case and the matter is indeed being taken on appeal to the Court of Appeal.
  2. So the question at issue as to the entitlement for this appeal to go ahead is to be determined effectively by the Court of Appeal in due course. Pending that determination it seems to me to be sensible that these proceedings be stayed and the only thing I would do would be to invite your solicitors to undertake, but not in the formal sense, that they will notify us as soon as the Court of Appeal case is determined. So if they could get in touch with us that would be very helpful.
